2. Terms and conditions of T_porto

2.1. Legislation, Regulation and Terms

The website concerns the advertising of T_porto, which is based in Chatzidaki 25, Rethymno, Postal Code 74132 on the island of Crete.

The legal terms and conditions that apply between T_porto and each prospective client will be unique and their validity depends on the scope of the cooperation between them. Each of the respective prospective clients will be informed of the terms and conditions of the cooperation between T_porto and the respective client. Each client will be informed of the terms and conditions of the cooperation with T_porto at the beginning of the cooperation. In case the individual client wishes to be informed before the case is assigned, he/she may request a copy of his/her file. The contracts of T_porto are governed by Greek Law.

2.3. Liability

The clients of T_porto are responsible for their own acts and omissions and are also responsible for the acts and omissions of anyone they invite to join or provide access to T_porto.

2.4. Compensation in case of damages

In the event of any damages incurred by the customer during the provision of transfer and tour services by T_porto, the company shall be liable to provide appropriate compensation to the affected party. In the event of any damage caused by the customer to T_porto, the customer is obliged to provide appropriate compensation to the affected party.

The company shall be held responsible for damages arising from its own negligence, willful misconduct, or failure to adhere to industry standards and regulations. However, the company shall not be liable for damages caused by factors beyond its control, including but not limited to acts of nature, government regulations, or actions of third parties. In the event of any damages, the affected party must notify T_porto immediately and provide sufficient documentation and evidence to support their claim. The company shall conduct a thorough investigation into the matter and assess the extent of liability.

2.5. Applicable Law and Jurisdiction

These Terms are governed by and construed in accordance with Greek law. If you are acting as a client of T_porto or as a legal entity or business, you agree to submit to the exclusive jurisdiction of the Greek Courts.

2.6. Caution for Internet Frauds

Caution: We take all reasonable steps to ensure the security of information. However, it is known – and we draw your attention – to the possibility of Electronic/Internet Fraud regarding emails. Whenever you have the slightest doubt about an email that you may have received from T_porto, we kindly ask and recommend that you do not reply or open any attachments. It would be wise to give us a call informing us of any concerns you may have so that we can enhance our knowledge in dealing with any illegal activities.

3. T_porto Privacy and Personal Data Protection Policy

It is solely your choice whether to visit and use our website by allowing us to collect personal data through cookies. However, if you choose to use pages that require you to fill in some of your personal information and data, you will do so given your consent and to respond to your request for booking information. This data will be used only for the above reasons and only by T_porto as legal entity. The processing of personal data is governed by the General Data Protection Regulation 2016/679 (“GDPR”) and all relevant Greek Legislative provisions. The use of your personal data takes place in accordance with your own instructions, the GDPR and all relevant Greek and EU legislative provisions.

We take care of our full compliance with our obligations under the GDPR and the relevant Greek and European Union (“EU”) legislation. We securely retain and delete your data securely and promptly. We protect your data by appropriate technical means from the risk of loss, interception and unauthorized use and access, to the extent that this is possible in today’s internet society.

The personal data of the clients of T_porto (name, surname, email address, residential address, telephone number, ID, passport, etc.) are considered confidential. Users, when providing their information in the context of their communication, consent and accept the imminent processing of these personal data for the needs of smooth communication/transaction between the parties. It is ensured that only T_porto has access to this information and only when necessary. T_porto undertakes not to disclose the details of the customers and their transactions, unless it has a written authorization from them, or this is required by a Court decision or a decision of another Public Authority.

Attention: not all personal data is sensitive, it is defined by the law, where you can refer it.

The processing of personal data that you voluntarily provide to us is done by us personally and no automated system is involved. No further data processing takes place and will not take place for any reason or purpose without your prior express consent where this is necessary. 3.5. The rights of clients as data subjects

Apart from the exceptions mentioned in the GDPR, you have the following rights regarding your personal data: (a) the right to request a copy of your data file, (b) the right to ask us to correct any personal data if it is found to be inaccurate, (c) the right to request the erasure of personal data, when it is no longer necessary for us to retain it, (d) the right, at any time, to withdraw your consent to processing (where the lawfulness of the processing requires your consent), (e) the right to submit a complaint to the Personal Data Protection Authority.

*It is noted that in case you request access to your personal data or deletion, modification, update thereof, there is no cost to you unless your relevant request is repeated and/or unfounded in which case you will incur a reasonable cost.

3.6. Retention of the Personal Data

We retain this data for as long as we manage your booking request and until you request its deletion and/or delivery while we reserve the right to retain electronic messages between us for five (5) years after the completion of your accommodation in T_porto with for the purpose of any probative force thereof regarding the services provided and the financial and/or other agreements between us.
